NYC bodega killing: thug’s girlfriend won’t be charged for stabbing worker  

Prosecutors claim that the woman has not been charged for attacking Alba because she was defending her boyfriend

The girlfriend of the man who was stabbed to death last week by a bodega worker in New York City will not be charged for stabbing the worker during the confrontation because she was allegedly defending her loved one, according to police sources. 

Last week, Manhattan bodega worker Jose Alba killed customer Austin Simon with a knife after the man confronted him and became violent. The incident has generated controversy, with some defending the worker’s actions as self-defense, while others are saying he should be charged for killing a man so brutally. 

The confrontation allegedly began when the slain man’s girlfriend entered the store to purchase potato chips but did not have enough money to buy them. She then calls her beau to threaten Alba. 

Simon confronts Alba, goes around the counter, and pushes him. Alba reacts by grabbing a nearby knife and stabs Simon several times. Simon died later that evening from his wounds. 

Recently, new videos surfaced showing the woman stabbing Alba three times while he was fighting with her boyfriend. 

While Alba was arrested and charged with one count of second-degree murder, insiders claim that the woman has not been charged for attacking Alba because prosecutors say she was defending her boyfriend. 

“The DA's office looked at the tape, and they felt she was defending her boyfriend. They didn't feel charges were necessary,” a police source told the New York Post. 

However, Francisco Marte of the Bodega and Small Business Association Group thinks she should have been charged. 

“I don't understand why the [district attorney] hasn't charged her,” he said. “She participated in that. She's supposed to be in jail and the $250,000 bail [Alba once faced] should be on her, not on him. He was just defending himself.” 

Alba was released from Rikers Island on a lower bond last week, after it was lowered from $250,000 to $50,000 due to the public’s outrage and criticism of how the incident had been handled.

'I didn't think this would happen. At that moment, I was in shock. I didn't know what to do and what to say. I feel very sad,” Alba told interviewers from his home.“ 'I didn't want to do this. This happened. I don't know in the moment how this happened.”
