President Biden was in possession of classified documents, but returned them to National Archives says lawyer

Classified documents were found late last year at President Biden’s Washington, D.C. based think tank, according to a statement released Monday from Biden’s attorney.

The classified documents, which were originally reported by CBS News, were first found in November by the president’s personal lawyers (not White House counsel) in the process of moving files at the Penn Biden Center for Diplomacy and Global Engagement in Washington, according to a statement released by lawyer Richard Sauber. 

On Nov. 2, after the documents were found, the White House reportedly notified the National Archives, which collected the documents the next day, the statement says. 

Mr. Sauber said the papers are a “small number of documents with classified markings” adding that the president’s attorneys “have cooperated with the Archives and the Justice Department in a process to ensure that any Obama-Biden Administration records are appropriately in the possession of the Archives.”
