U.S. Sen. Rubio says Biden's Supreme Court nominee should follow the Constitution
The Florida based senator said all Supreme Court justices should follow the Constitution whether they agree with the policy outcome or not

U.S. Senator Marco Rubio said on Thursday in a statement that he would judge President Biden’s nominee for supreme court justice based on whether they follow the constitution and apply it whether they agree with the policy outcome or not.
“My decision on any Supreme Court nominee will be based on the individual’s commitment to original intent and understanding that the Supreme Court is a ‘trier of law’ appellate court and not a ‘trier of fact’ trial court,” Rubio said. “This is critically important because too many in the federal judiciary today believe it is appropriate for judges to craft new policies and create rights instead of interpreting and defending the Constitution as written.”
Supreme Court Justice Stephen Breyer will step down at the end of the court’s current term. Breyer, 83, is one of the three remaining Democrat-appointed justices in the Supreme court.
With Breyer’s retirement, President Biden will be able to appoint a liberal-leaning justice when the court’s new term begins in October.
