Supreme Court silent on whether Justice Thomas is still hospitalized

Supreme Court Justice Clarence Thomas missed a third day of oral arguments on Wednesday after he was hospitalized for an infection last week, and the Supreme Court would not confirm whether he has been discharged.

Chief Justice John Roberts told the court ahead of arguments Wednesday that Thomas was "unable to be present today," The Associated Press reported. Roberts has made the same statement the past two days, explaining that while Thomas could not be in the court he would participate by reviewing argument transcripts and briefs.

Thomas, who is considered the most conservative Supreme Court Justice, was scheduled to be released from the hospital by Tuesday. He was admitted Friday with "flu-like symptoms" that the court said two days later were "abating."

Court spokeswoman Patricia McCabe told the AP on Wednesday that she did not have an update on Thomas' condition.

When the Epoch Times reached out to the court, a spokeswoman would not say whether Thomas was still hospitalized.

She pointed the outlet back to the Sunday press release and said, "That’s the only information we have available at this time."

The 73-year-old justice's hospitalization comes as the Senate is conducting hearings to confirm Judge Ketanji Brown Jackson as a replacement for Justice Stephen Breyer, who is retiring this summer.
